I agree with Jerry... the first example looks legit. The second pic is too blurry and overexposed (at least on my monitor) for me to make any judgements.

In 2569 the 2 is seriffed as I’d expect and the character overall looks like the normal type for 38.
But in the alleged 2949 the 2 appears to be sans serif and that would be unusual for 38. And is that 2 the same as the 2 on the front cylinder?
Also notice the E. The upper and lower strokes appear about the same length as each other and that’s what I’d expect for 38. Also for 38 I’d expect the centre stroke to be shorter than the other strokes but on this occasion it may be too short? Ask the seller for a clear close-up of the entire SN.
What are the BNs? Ask the seller for clear close-ups of both of them.
In other pictures of that bike I see a DC on the left case but I can’t read it. Ask the seller for a photo of it.

**In the 2nd picture, the pad appears to have been carefully ground down and re~stamped. Max the picture, and look at the outline.
